Welcome to Asher Jobs. These Terms of Service ("Terms") govern your access to and use of the Asher Jobs platform, including our website, mobile applications, and related services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Platform.

1. Acceptance of Terms

By creating an account, accessing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Asher Jobs.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms.

2. Eligibility

You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations
• All information you provide is accurate, current, and complete
• You will maintain the accuracy of such information

3. Account Registration and Security

3.1 Account Creation

To access certain features of the Platform, you must create an account. When creating an account, you agree to:

• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

3.2 Account Types

The Platform offers different account types with varying features and permissions:

• Pioneer: Individual professional account with access to networking, jobs, and courses
• Game Changer: Team member account with collaborative features
• Team Leader: Manager account with team management and analytics capabilities
• Company Account: Organization account for posting jobs and managing teams
• Admin/GM: Administrative accounts with platform management privileges

4. User Conduct and Prohibited Activities

You agree to use the Platform in a professional and lawful manner. You agree NOT to:

• Post false, misleading, or fraudulent information
• Impersonate any person or entity
• Harass, abuse, threaten, or intimidate other users
• Post offensive, discriminatory, or inappropriate content
• Use profanity, hate speech, or sexually explicit content
• Spam or send unsolicited messages to other users
• Violate any intellectual property rights
• Attempt to gain unauthorized access to the Platform or other users' accounts
• Use automated tools (bots, scrapers) without permission
• Interfere with or disrupt the Platform's operation
• Post malicious code, viruses, or harmful software
• Use the Platform for any illegal purpose
• Violate any applicable laws or regulations

5. Content Ownership and Intellectual Property

5.1 Your Content

You retain ownership of all content you post on the Platform (posts, comments, profile information, resumes, etc.). By posting content, you grant Asher Jobs a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display your content for the purpose of operating and improving the Platform.

5.2 Platform Content

All content provided by Asher Jobs, including courses, text, graphics, logos, images, software, and other materials (collectively, "Platform Content"), is owned by Asher Jobs or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Platform Content without our express written permission.

5.3 Course Materials

Course materials are provided for your personal, non-commercial use only. You may not reproduce, distribute, or create derivative works from course materials without permission.

6. Course Enrollment and Completion

6.1 Enrollment Policies

When you enroll in a course:

• You gain access to course materials for the duration of your enrollment
• You must complete courses according to the specified timeline
• You may be subject to enrollment limits based on your account type
• Course assignments by Team Leaders are binding for team members

6.2 Exams and Assessments

For courses with exams:

• You must complete all required lessons before taking the exam
• You have a limited number of retake attempts (typically 3)
• Cheating or academic dishonesty will result in account suspension
• Certificates are awarded only upon successful completion

6.3 Dropping Courses

You may drop a course at any time, but this may affect your enrollment limits and team performance metrics if you are part of a team.

7. Team Management and Company Accounts

7.1 Team Leader Responsibilities

Team Leaders agree to:

• Manage team members professionally and ethically
• Assign courses appropriately based on team needs
• Respect team members' privacy and data
• Use analytics and performance data responsibly
• Not discriminate or harass team members

7.2 Team Member Rights

Team members (Game Changers) have the right to:

• View their own performance data and analytics
• Access assigned courses and learning materials
• Leave a team at any time (subject to employment agreements)
• Report inappropriate behavior by Team Leaders

7.3 Company Accounts

Companies using the Platform agree to:

• Provide accurate company information
• Post legitimate job openings only
• Comply with employment laws and regulations
• Respect applicant privacy and data
• Not discriminate in hiring practices

8. Job Postings and Applications

8.1 Job Postings

Companies posting jobs agree that:

• All job postings must be for legitimate, available positions
• Job descriptions must be accurate and not misleading
• Postings must comply with employment and anti-discrimination laws
• We reserve the right to remove any job posting that violates these Terms

8.2 Job Applications

When applying for jobs:

• Provide accurate and truthful information in your application
• Your application will be shared with the employer
• We are not responsible for employer actions or hiring decisions
• We do not guarantee job placement or interviews

9. Payments and Subscriptions

If we offer paid features or subscriptions in the future:

• You agree to pay all fees associated with your subscription
• Fees are non-refundable except as required by law
• We may change pricing with advance notice
• Failure to pay may result in suspension of your account
• You are responsible for all taxes associated with your purchase

10. Termination and Suspension

10.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in your settings. Upon termination, your access to the Platform will cease, and your data will be deleted in accordance with our Privacy Policy.

10.2 Termination by Us

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Posting prohibited content
• Harassment or abuse of other users
• Failure to pay fees (if applicable)
• Inactivity for an extended period

10.3 Effect of Termination

Upon termination:

• Your right to access the Platform immediately ceases
• We may delete your account and data
• You remain liable for any obligations incurred before termination
• Provisions that should survive termination will remain in effect

11. Disclaimers and Limitations of Liability

11.1 Platform "As Is"

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11.2 Third-Party Content

We are not responsible for content posted by users, job postings by employers, or any third-party content on the Platform. We do not endorse, verify, or guarantee the accuracy of user-generated content.

11.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASHER JOBS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Platform
• Any unauthorized access to or use of our servers or your data
• Any interruption or cessation of the Platform
• Any bugs, viruses, or harmful code transmitted through the Platform
• Any errors or omissions in content
• Any conduct or content of third parties on the Platform

12. Indemnification

You agree to indemnify, defend, and hold harmless Asher Jobs, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your violation of any rights of another person or entity.

13. Dispute Resolution and Governing Law

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Egypt, without regard to its conflict of law provisions.

13.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or the Platform shall be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration in Cairo, Egypt, in accordance with Egyptian arbitration laws.

13.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

14. Miscellaneous

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Asher Jobs regarding the Platform.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.
